Abstract

“One can benefit from a wrong without being guilty of wrongdoing. Unjustified enrichment as a cause of action is an example” South African Police Service v Solidarity obo Barnard 2014 6 SA 123 (CC) 165A with reference to Ackermann Human Dignity: Lodestar for Equality in South Africa (2012) 345-346 who remarked “like unjustified enrichment, restitutionary measures do ‘not rest upon proof of guilt, but on proof of unjustified enrichment on the part of the advantaged’”.
